BACKGROUND: On January 31st, 2020, the UK has officially left the EU, being no longer a Member State. A transition period, as foreseen in the Withdrawal Agreement, was then agreed by the two blocks. This transition period will be in force until December 31st, 2020, being assured that during that period the previously existing rights of citizens, consumers, companies, investors, students, and researchers, either within the EU and the UK will be maintained.

UK NATIONALS WHO ALREADY HOLD A CERTIFICATE OF PERMANENT RESIDENCY IN PORTUGAL:

UK nationals or their relatives already holding a certificate of permanent residency in Portugal as an EU citizen will benefit from a right of residency in the same terms as before Brexit, being subject to the respective rights and obligations to which they were already subject to. In this case it is not necessary to proceed with any action to maintain the residency right.

However, should the permanent residency certificate expire, it is necessary to renew it at the Immigration and Borders Service (SEF).

UK NATIONALS WHO DO NOT YET HAVE A PERMANENT RESIDENCY CERTIFICATE IN PORTUGAL:

UK nationals who already live in Portugal and are duly registered as EU citizens, having obtained the correspondent certificate, can still request at SEF the issuing of a permanent residency certificate, once completed the 5 year-period of legal residency in Portugal. Until the completion of such period, as well as after obtaining the permanent residency certificate, all the rights regarding residency in Portugal will be maintained. Once completing the 5 year-period, or if the citizen already lives in Portugal for more than 5 years, the permanent residency certificate should be requested at SEF.

UK NATIONALS NOT REGISTERED AS EU CITIZEN:

UK nationals already living in Portugal but who have never registered as EU citizens, by obtaining the correspondent residency certificate, must request the issuing of the certificate, or even of the permanent residency certificate, during this transition period (in force until the end of 2020).

After completing the 5 year-period of legal residency in Portugal they can request near SEF the permanent residency certificate. Until then, and regardless of when the 5 year-period is completed, UK nationals maintain all the pre-existing residency rights deriving from being EU citizens. In case of residency in Portugal for more than 5 years but without previously being registered as EU citizen (therefore, without an EU citizen certificate), it is also possible to request directly the issuing of a permanent residency certificate at SEF. With this objective at mind, it should be proved the residency in Portugal for more than 5 consecutive years.

UK nationals benefit from their European citizenship rights such as free movement and residency until the end of 2020.

Given the above, UK nationals will be able to exercise their right of free movement and residency in Portugal in the same terms as before Brexit, until 31st December, 2020, but they must already be Portuguese residents or become one until 31st December, 2020.
